This was potentially in violation to the required opt-in process that must be part of all mobile marketing.  Just because you signed up to receive a ringtone does not mean that you wanted to receive information about a novel.  Hence, a class action lawsuit ensued against Nextones.com.

The potential penalty for Nextones.com was as scary as a Stephen King novel.  Faced with going to trial and possibly paying $500 to $1500 in damages for each call, the defendants have agreed to settle.  A settlement fund of $10 million, of which plaintiff attorneys will receive $2.725 million.
